Bir\u00e7ok hukuk sisteminde evlilik birli\u011fi i\u00e7inde ve evlilik birli\u011finin sona ermesiyle olu\u015facak y\u00fck\u00fcml\u00fcl\u00fckler toplumsal ve ahlak\u0131 saiklerle d\u00fczenlenmi\u015ftir. Bu \u00e7al\u0131\u015fman\u0131n amac\u0131, \u0130slam ve Asya \u00fclkelerinde evlilik birli\u011finin sona ermesi ile nafaka ve mal rejimi uygulamalar\u0131n\u0131n incelenmesi ve bu uygulamalar\u0131n temel yap\u0131s\u0131n\u0131n de\u011ferlendirilmesidir.<\/p>\n\n\n\n<p><strong>SUUD\u0130 ARAB\u0130STAN<\/strong><\/p>\n\n\n\n<p>Suudi Arabistan Aile Hukukunda, mal rejimi kural ve kaidelerinde mal ayr\u0131l\u0131\u011f\u0131 esas olup, e\u015flerin birbirlerinin edindikleri veya edinecekleri mallar\u0131 \u00fczerinde bir ortakl\u0131k veya payla\u015f\u0131m hakk\u0131 yoktur<a>. Evlilik birli\u011fi i\u00e7inde kocan\u0131n kar\u0131s\u0131na kar\u015f\u0131 belli mali sorumluluklar\u0131 <\/a>vard\u0131r. Bu sorumluluklar mehir ve nafaka olarak iki k\u0131sma ayr\u0131lmaktad\u0131r. Mehir nik\u00e2h akdinin bir sonucu olarak erke\u011fin kad\u0131na \u00f6demesi gereken mal cinsinden bir kar\u015f\u0131l\u0131kt\u0131r. Mehir kad\u0131n\u0131n \u015fahsi mal\u0131d\u0131r ve tasarruf hakk\u0131 tamamen kendisine aittir. Kad\u0131n\u0131n nafaka hakk\u0131 ise evlilik birli\u011fi devam etti\u011fi m\u00fcddet\u00e7e s\u00fcrekli olarak devam etmektedir. Bo\u015fanma durumunda ise, nafaka erke\u011fin tek tarafl\u0131 geri d\u00f6nme hakk\u0131 olan bo\u015fanmalarda iddet s\u00fcresi sonlanana kadar devam etmektedir. Bedel kar\u015f\u0131l\u0131\u011f\u0131 anla\u015fmal\u0131 bo\u015fanmalarda, Mahkeme karar\u0131 ile anla\u015fmal\u0131 veya \u00e7eki\u015fmeli bo\u015fanmalarda ise erke\u011fin tek tarafl\u0131 bo\u015fanma haklar\u0131n\u0131n t\u00fckenmesi sebebiyle kesin ayr\u0131l\u0131k durumu olu\u015ftu\u011fundan kad\u0131n\u0131n bireysel nafaka hakk\u0131 sonlanmaktad\u0131r. Ancak kesin bo\u015fanmalar d\u00e2hil ayr\u0131l\u0131klarda kad\u0131n hamile ise do\u011fum yap\u0131ncaya kadar bireysel nafaka hakk\u0131 devam eder. Kocan\u0131n \u00f6l\u00fcm\u00fc durumunda kad\u0131n\u0131n \u015fahsi nafaka hakk\u0131 sonlanmaktad\u0131r. Kad\u0131n hamile ise do\u011fum yap\u0131ncaya kadar \u00e7ocu\u011fun hakk\u0131 olan mirastan genel nafaka hakk\u0131 ve iddeti sonlan\u0131ncaya kadar kocas\u0131n\u0131n ona sa\u011flad\u0131\u011f\u0131 evde kalma hakk\u0131 devam etmektedir. Suudi Arabistan Aile Hukukuna g\u00f6re, evlilik birli\u011fi devam ederken nafaka hakk\u0131n\u0131 d\u00fc\u015f\u00fcr\u00fcc\u00fc tek sebep kad\u0131n\u0131n \u015fer\u2019\u00ee bir gerek\u00e7e olmaks\u0131z\u0131n evlilik evini terk etmesidir. Evlilik birli\u011fi sonland\u0131ktan ve iddet m\u00fcddeti bittikten sonra kad\u0131n\u0131n kendi \u015fahs\u0131 i\u00e7in adam \u00fczerinde herhangi bir sebeple maddi \u00f6deme talep etme hakk\u0131 yoktur.<\/p>\n\n\n\n<p><strong>B\u0130RLE\u015e\u0130K ARAP EM\u0130RL\u0130KLER\u0130<\/strong><\/p>\n\n\n\n<p>Birle\u015fik Arap Emirlikleri\u2019nde kanun koyucu, evlili\u011fin sonu\u00e7lar\u0131 ba\u015fl\u0131\u011f\u0131 alt\u0131nda nafaka ve nesep olmak \u00fczere iki konuya yer vermi\u015ftir. Nafaka ba\u015fl\u0131\u011f\u0131 alt\u0131nda, zevcenin, akraban\u0131n ve kimsesizlerin nafakas\u0131n\u0131 ele alm\u0131\u015ft\u0131r. Kad\u0131n\u0131n kendi mal\u0131nda tam yetkili oldu\u011funu, kendi mal varl\u0131\u011f\u0131 \u00fczerinde y\u00f6netim, yararlanma ve tasarruf hakk\u0131 bulundu\u011funu ve kar\u0131s\u0131n\u0131n r\u0131zas\u0131 olmadan kocas\u0131n\u0131n onun mal\u0131nda herhangi bir tasarrufa gitmesinin caiz olmad\u0131\u011f\u0131n\u0131 ifade ederek e\u015fler aras\u0131nda mal ayr\u0131l\u0131\u011f\u0131 rejimi oldu\u011funu vurgulam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Kanun koyucu, nafakay\u0131 ise yeme-i\u00e7me, giysi, mesken, sa\u011fl\u0131k giderleri yan\u0131nda kad\u0131n\u0131n sosyal konumunun gerektirmesi halinde hizmet\u00e7i tutmay\u0131 da kapsayacak \u015fekilde d\u00fczenlemi\u015ftir. Nafaka miktar\u0131n\u0131n ise nafaka verenin ekonomik g\u00fcc\u00fc yan\u0131nda, nafakaya ihtiya\u00e7 duyan\u0131n hali, zaman ve oturum yeri olarak ge\u00e7im \u015fartlar\u0131 dikkate al\u0131narak belirlenece\u011fi ifade edilmi\u015ftir. &nbsp;Kanun, erkek e\u015fe ev reisli\u011fi, aileyi temsil ve bo\u015fama yetkisini vermi\u015ftir. Kanun, yetki ve k\u00fclfet dengesini kurmak amac\u0131yla nafaka y\u00fck\u00fcml\u00fcs\u00fcn\u00fc erkek e\u015fe vererek kad\u0131n\u0131, erkek e\u015fe ba\u011fl\u0131 tutmu\u015ftur. Bu \u015fekilde uygulamada ve kanunda ikilik yarat\u0131lmamaya \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p><strong>KATAR<\/strong><\/p>\n\n\n\n<p>Bo\u015fanan kad\u0131n, bo\u015fanman\u0131n meydana geldi\u011fi tarihten itibaren iddetin tamamlanmas\u0131na kadarki s\u00fcre i\u00e7erisinde, iddet nafakas\u0131na hak kazan\u0131r.<\/p>\n\n\n\n<p><strong>\u0130RAN<\/strong><\/p>\n\n\n\n<p>\u0130ran Hukukunda bo\u015fanma sonra e\u015fler aras\u0131nda mal ayr\u0131l\u0131\u011f\u0131 rejimi esast\u0131r. Bo\u015fanma sonras\u0131 nafaka s\u00fcresi ise, kad\u0131n\u0131n iddet s\u00fcresi kadard\u0131r. \u0130ddet s\u00fcresi dolduktan sonra kad\u0131n\u0131n nafaka hakk\u0131 d\u00fc\u015fmektedir.<\/p>\n\n\n\n<p><strong>IRAK<\/strong><\/p>\n\n\n\n<p>Mal ayr\u0131l\u0131\u011f\u0131 esas\u0131 kabul edilmi\u015ftir. Koca iddet d\u00f6neminde olan kad\u0131n\u0131n nafakas\u0131 \u00fcstlenmek zorundad\u0131r. \u0130ddet d\u00f6neminde evlilik m\u00e2nen devam etti\u011fi i\u00e7in nafaka miktar\u0131 ayn\u0131 evlilik d\u00f6nemindeki gibi olaca\u011f\u0131 d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p><strong>CEZAY\u0130R<\/strong><\/p>\n\n\n\n<p>E\u015fler aras\u0131ndaki mal rejimi esas al\u0131nm\u0131\u015ft\u0131r. Ancak akit esnas\u0131nda evlilik hayat\u0131nda ortak olarak elde ettikleri mallarda ortak olabilecekleri veya m\u00fcstakil olarak bir ki\u015finin zimmetine ge\u00e7ebilece\u011fi \u015feklinde anla\u015fmalar\u0131 m\u00fcmk\u00fcnd\u00fcr. Mal rejiminin ayr\u0131l\u0131k olmas\u0131 e\u015flerin ortak olabileceklerine engel te\u015fkil etmemektedir. Yaln\u0131zca ihtilafl\u0131 durumlarda bu kural esas al\u0131narak erke\u011fin kulland\u0131\u011f\u0131 mallar erke\u011fe verilirken kad\u0131n\u0131n kulland\u0131\u011f\u0131 mallar kad\u0131na verilecektir. Nafaka ise, kad\u0131n\u0131n iddet s\u00fcresi kadard\u0131r.<\/p>\n\n\n\n<p><strong>\u00c7\u0130N<\/strong><\/p>\n\n\n\n<p>\u00c7in Hukukunda, e\u015fler aras\u0131nda, ki\u015fisel mallar ile evlilik birli\u011fi i\u00e7inde edinilmi\u015f mallar birbirinden ayr\u0131lmaktad\u0131r. Edinilmi\u015f mallarda, evlilik birli\u011fi i\u00e7inde edinilmi\u015f olma ve emek kar\u015f\u0131l\u0131\u011f\u0131 edinme \u00f6l\u00e7\u00fctlerini esas alan bir rejim benimsenmektedir. Bo\u015fanma durumunda, \u00e7ocuk iki ya\u015f\u0131n\u0131 doldurana kadar anne ve baban\u0131n birlikte velayeti alt\u0131ndad\u0131r. Taraflar \u00e7ocu\u011fun velayeti konusunda anla\u015famazlar ise hakim \u00e7ocu\u011fun \u00fcst\u00fcn yarar\u0131n\u0131 g\u00f6zeterek velayeti e\u015flerden birine vermektedir. \u00c7ocuk sekiz ya\u015f\u0131n a geldi\u011finde ise \u00e7ocu\u011fun ger\u00e7ek iradesine g\u00f6re velayetin kimde olaca\u011f\u0131 belirlenmektedir. Velayet kendisine b\u0131rak\u0131lmayan e\u015f, \u00e7ocu\u011fun ihtiya\u00e7lar\u0131 do\u011frultusunda i\u015ftirak nafakas\u0131 \u00f6demektedir.<\/p>\n\n\n\n<p><strong>JAPONYA<\/strong><\/p>\n\n\n\n<p>Japon hukukunda iki taraf\u0131nda bo\u015fanmak istemesi halinde, mahkemeye gerek olmaks\u0131z\u0131n, taraflar belediyeden al\u0131nan bo\u015fanma ka\u011f\u0131d\u0131n\u0131 imzalayarak ger\u00e7ekle\u015ftiriyorlar. Bo\u015fanma halinde kad\u0131n, erke\u011fin gelirinin yar\u0131s\u0131 kadar nafaka alabilmektedir. Japon Hukuku, bo\u015fanma usul\u00fcn\u00fcn kolay ve h\u0131zl\u0131 olmas\u0131 sebebiyle bo\u015fanmalar\u0131n artmas\u0131n\u0131n nafaka y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ile \u00f6n\u00fcne ge\u00e7meyi ama\u00e7lamaktad\u0131r.<\/p>\n\n\n\n<p><strong>TAYLAND<\/strong><\/p>\n\n\n\n<p>Nafakan\u0131n \u00f6denmesi, al\u0131c\u0131 taraf\u0131n finansal olarak ba\u011f\u0131ms\u0131z hale gelmesine ve iki taraf\u0131n tamamen ayr\u0131lmas\u0131na izin vermek i\u00e7in sabit bir s\u00fcre i\u00e7in belirlenmektedir. Tayland hukuku, evlilik \u00f6ncesi m\u00fclkiyet, ki\u015fisel m\u00fclkiyet ve evlilik s\u0131ras\u0131nda girilen m\u00fclkiyet aras\u0131nda ayr\u0131m yapmaktad\u0131r. Tayland hukukunda, evlilik \u00f6ncesi taraflar aras\u0131nda yap\u0131lan s\u00f6zle\u015fmeler ge\u00e7erli olup, evlilikten \u00f6nce taraflar\u0131n varl\u0131klar\u0131n\u0131 belirlemek i\u00e7in kullan\u0131l\u0131r. Ancak evlilik s\u00f6zle\u015fmesi olmasa bile, evlilik \u00f6ncesi mal ve bor\u00e7lar\u0131n ki\u015fisel oldu\u011fu ve evlilik s\u00fcresince biriktirilen her \u015feyin taraflar aras\u0131nda e\u015fit olarak payla\u015ft\u0131r\u0131lacakt\u0131r.<\/p>\n\n\n\n<p><strong>SONU\u00c7<\/strong><\/p>\n\n\n\n<p>\u0130slam \u00fclkelerinde nafakan\u0131 tan\u0131m\u0131, evlilik birli\u011fi i\u00e7inde kocan\u0131n kar\u0131s\u0131na kar\u015f\u0131 belli mali sorumluluklar\u0131 olarak d\u00fczenlenmi\u015ftir. Asya \u00fclkelerinde ise bu tan\u0131m, evlilik birli\u011fi i\u00e7inde e\u015flerin birbirine kar\u015f\u0131 olan mali sorumluluklar\u0131 olarak d\u00fczenlenmi\u015ftir. Evlili\u011fin sona ermesinden sonra ise e\u015flerin birbirine kar\u015f\u0131 olan y\u00fck\u00fcml\u00fcl\u00fckleri sona erip, \u00e7ocu\u011fun bak\u0131m\u0131, g\u00f6zetimi gibi y\u00fck\u00fcml\u00fcl\u00fckler devam etmektedir. \u0130slam ve Asya \u00fclkelerinde evlilik birli\u011finin sona ermesinden sonraki s\u00fcre\u00e7te esas al\u0131nan temel \u00e7ocuk ve \u00e7ocu\u011fun \u00fcst\u00fcn yarar\u0131d\u0131r.<\/p>\n\n\n\n<p>Evlili\u011fin sona ermesi ile bo\u015fanan e\u015flerin birbirleri ile zorunlu ili\u015fkilerinde belirli bir s\u00fcre mevcut olup, devam\u0131nda taraflar yaln\u0131zca m\u00fc\u015fterek \u00e7ocuklar\u0131 ve \u00e7ocuklar\u0131n\u0131n giderleri ile sorumludurlar.
